General Terms & Conditions
Your access to, and use of, the website, use of services and products able to be purchased via the website is subject to the following terms and conditions. By using the website you represent that you have read, understood and accepted these terms and conditions, and agree to be bound by them. If you do not agree to the Terms, please do not use the site.
Any links to third party websites are provided for convenience only. For the purposes of this clause a “third party website” is any website other than the Gourmet Brothers website. Our team shall endeavour to prevent any unauthorised entry into the website. However, Gourmet Brothers will not be liable for any direct or indirect damage or loss whatsoever if any third party unauthorised access.
You agree not to use the Website for any purpose that is unlawful or prohibited by these terms and conditions. Neither the website, nor any material on it, may be altered, modified, reproduced, transmitted or distributed without Gourmet Brothers’ prior written consent.
Once we receive your order, we carefully prep your meals & send them to you safely via NZ post in a temperature controlled container.
Orders made by Sunday 11:59pm will be delivered by Thursday the following week.
We currently deliver to suburbs Nation Wide. A flat rate of $10 is charged for South Island delivery and $15 for North Island Delivery. Deliveries will, subject to these terms and conditions, be made to the delivery address on the delivery date selected.
Gourmet Brothers shall be entitled to assume that any person accepting the delivery of the meal/s are either the customer or someone that is authorised to do so on behalf of the customer.
Once delivered you are responsible for all ingredients. The shipping box allows your meal/s to be left in a shaded area for up to 3 hours (this may change based on weather temperature) and we recommend unpacking your meal/s as soon as possible to maintain freshness.
Gourmet Brothers will not be liable for any damage to the product if left outside for extended periods of time nor if box is damaged or stolen after delivery. It is your obligation to enter the correct delivery address details at time of ordering.
If you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.
If you live in a secured apartment complex, please ensure you are home to receive your delivery during the time frame provided.
If no one is available to collect your delivery please arrange a suitable time with our team prior to the delivery date.
If our driver is unable to access the apartment your items will be left at the gate, and you will be notified via email. It is the responsibility of the customer to inform Gourmet Brothers by contacting us if an order does not arrive.
Once we learn an order has not arrived on the due date, we will enquire into it to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery. Gourmet Brothers always aims to deliver on time, but may from time to time, be delayed and shall not be liable for failure to deliver on a timely basis.
If Gourmet Brothers deems the delivery of your order is likely to be substantially delayed, our team will contact you (via phone, text or email) to arrange an alternative delivery timeframe. If that timeframe is unacceptable to you, you may decline to accept the order and Gourmet Brothers will credit you with the cost of that meal/s.
Ownership, responsibility and risk in the products shall pass to the customer on delivery to the nominated address on the order.
Pricing and Payment
All prices are in New Zealand Dollars (NZD). Any transactions or purchases online can be made via MasterCard, Visa or debit card only. All transactions are processed via our partners Shopify payment services. All payments have to be made before your meal/s can be delivered.
The prices are per meal, and are listed on the Website accordingly. Prices of meals are inclusive of GST. Where additional delivery costs are applicable, these costs will be clearly indicated during the order process. Delivery costs are inclusive of GST.
Gourmet Brothers reserves the right to change pricing at any time.
Gourmet Brothers reserve the right to accept or reject your order for any reason, such as the unavailability of any product or service, an error in the price of the product or service or an error in your order.
Order Cancellations By Us
We reserve the right not to provide goods or services, remove or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.
All credit card payments are processed securely through a PCI compliant Payment Gateway (DPS) and payments are made directly through Encryption software to ensure your personal details are kept safe. Gourmet Brothers Limited do not store any credit card information on our servers. We may also change or add additional payment gateways to our website in the future. We take reasonable steps to protect your personal information. However we are not liable for any unauthorised access to this information.
Discounts & Promotions
Discounts or promotion codes are non-transferable and cannot be transferred or refunded for cash. Furthermore, Gourmet Brothers Limited reserves the right to cancel any promotion or discount without prior notice. One discount or promotion code per order, and cannot be used in conjunction with any other discounts or promotions.
Refund & Cancellation Policy
There are no cancellations after the 10pm cut off time on Sunday, the week before the relevant delivery date.
In order to create your order, our team starts sourcing ingredients immediately after the orders lock at 10pm on Sunday. Once the ingredients for your meal have started to be sourced, we are unable to accept cancellations after this point.
There are certain situations where refunds or credits may be granted (if applicable).
- Incorrect meals are delivered
- Damaged or missing meals
- Poor quality or missing ingredients from meals.
- Delivery errors out of the customer’s control.
Please note that refunds or credits will not be processed for accidental orders or change of mind.
Any credit applied to your order will be sent as a voucher, valid for up to 12 months from issue. The voucher is non-transferable, cannot be exchanged or refunded for cash.
We process all refunds immediately. Depending on your bank’s processes, it can take up to 7 business days for a refund to appear back in your account. Any refunds or credits are subject to our T&Cs.
Your delivery information will be confirmed at point of order. Any redirect (change of address) of your order must be made by the Sunday prior to the week of delivery. Any urgent changes, we advise you to please call us.
Please note, redirections can only be made before Sunday - 10pm the week before the relevant delivery date.
Due to the perishability of fresh meal products we cannot accept returns. Perishable goods such as food are exempt from being returned.
Product availability and quality
Gourmet Brothers will make every effort to fulfil orders placed within the website, however we will not be liable to any person if we are unable, or decline, to supply a meal for any reason whatsoever, other than to refund the amounts paid in respect of the meal.
We reserve the right to limit quantities able to be ordered by, or delivered to, Customers. If a Customer’s order is reduced in accordance with this clause, the price payable by you for that order will be adjusted accordingly. Gourmet Brothers may alter recipes or ingredients due to stock availability.
In establishing that a product was damaged or spoiled on delivery to you, we may require photographic evidence and/or a sample of the damaged or spoiled product.
If Gourmet Brothers agrees that a product was delivered to you in a damaged or spoiled condition, Gourmet Brothers shall, at your request, credit the value of the relevant meal back to you. We will credit you by either crediting the credit card you paid with or supply a voucher which is not-transferable and cannot be exchanged or refunded for cash.
All products will be labelled and supplied with a ‘best before’ date. Please check all ‘best before’ dates on arrival and consume before this date. Most seafood, poultry and meat products can be frozen, unless labelled otherwise. If you prefer to heat your meals later in the week, just check the expiration date of your items first. Seafood recipes are best eaten first, followed by chicken, then pork, then red meat.
Cook times are indicative only and individual customer results may vary.
We’d like you to know all of our nutrition information provided is an approximate. This is based off purchased ingredients and volumes combined with ingredient brands and using recipe volumes. All information is calculated as accurately as possible.
Gift vouchers may be purchased online, but we can only currently deliver meals to addresses within the Christchurch area that we service (so you need to be certain that your intended recipient is within an area that we service when purchasing). We will deliver gift vouchers purchased by you via email to your email address.
You are responsible for ensuring that all information provided in relation to purchase is correct. Only Gourmet Brother vouchers can be redeemed on the website. Go to the “Gift Voucher” tab on the website, enter the voucher number and then follow the instructions to complete your purchase(s).
Gift Voucher terms and conditions
Gift vouchers can be partially redeemed. The un-used balance is non-refundable. Minimum gift voucher value has to be for the amount equivalent to four meals plus delivery, and maximum gift voucher amount is $500. All gift vouchers expire 12 months from date of purchase. A gift voucher cannot be reloaded, and unused balances at the expiry date will not be refunded. Gourmet Brothers are not responsible if a gift voucher is used without permission. Gift vouchers will not be refunded or replaced. Gift voucher value cannot be redeemed for cash or credited to a bank account. All purchases of a meal/s using a gift voucher will otherwise be subject to these terms and conditions.
Website Content and Changes
Gourmet Brothers has endeavoured to ensure that the information provided on the website is free from error, Gourmet Brothers does not warrant its accuracy, adequacy or completeness, and Gourmet Brothers shall not be responsible or liable for any error in, or omission from, the information provided on the website. We reserve the right to make changes to the information provided on the website at any time and without notice. We may update this document from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
Notwithstanding any other term, you agree to indemnify Gourmet Brothers against all liabilities, losses, claims and expenses suffered or incurred by you, and all claims and demands made against Gourmet Brothers, arising directly or indirectly out of your use of the Website, in breach of these terms and conditions.
